MLM (Multi Level Marketing) and Direct Selling fall under the bigger umbrella of Network Marketing - It is one of the most powerful home based business mediums today.  However, the general public’s lack of understanding and the misconceived and tainted reputation of MLM often precede it because of several illegal pyramid schemes that have come about.


MLM and network marketing is a means to distribute products and services and is actually a huge, $100 million dollar industry.  It evolved from the basic concept of a door-to-door salesman to what it is today and direct selling has never been the same.  The Amway Safeguard Rule was what set the legal standard to ensure that the Federal Trade Commission rules are followed, in response to the pyramiding scheme outbreak of the 70’s and it also ensures the validity of the business opportunity through three important points.  These points look into requirements such as the retail sale of the products and services to qualify for any recruiting commissions and /or sales, a mechanism in place to avoid over stocking of inventory without the intention of reselling and the opportunity for a buy back provision for unsold, undamaged and unopened inventory from the representatives who choose to leave.

When To Seek Legal Advice In Your Home Business

As the title of this article suggests, getting legal advice related to your home business is not an 'if', but rather a 'when’.  Among other things, having a lawyer review any legal documents or contracts you may draft or sign, while expensive, will more than pay for itself if you should ever run into problems down the road.  Think of it as homeowner’s insurance for your home business; hopefully you’ll never have to defend a patent or dispute a contract, but if someday you do, you’ll want to know that you have an airtight case legally.

The typical approach for most first time entrepreneurs is to only bring a lawyer into the situation when they feel it is getting out of hand, however much of the work a lawyer can do for your small business will preempt problems that may arise down the road.  It is not uncommon for a small business to work regularly with a lawyer and in many cases, bringing a lawyer onto the team can be a great idea to keep you legal from the beginning and every step along the way.  This is often cost-prohibitive for new small businesses, however giving away even a small piece of the company (perhaps 1 or 2 percent) will be well worth it if it buys you legal expertise from the outset.

If you neglect to consult a lawyer at the beginning and even decide to draw up your own contracts and foundational documents without a lawyer, if someone decides to take legal action against you and your company, this is where you will absolutely need to seek the help of a lawyer.  Depending on how you incorporated your small business, you may have left yourself liable personally, and if you neglected to properly patent any technologies you are selling in your business, it may be a game ender for your business.  The moral of the story is, find a way to get legal counsel at the outset of your business, if you can’t afford it when you’re starting out, reach out to a relative or friend who is a lawyer and simply asking their advice on which type of corporation to form will help protect you personally if you run into trouble down the road.

How To Grow Your Small Business

Many small businesses are created with the goal of eventually becoming large businesses. Growth should be an integral part of nearly any business, because like it or not, businesses that plateau, soon begin to decline. Much of growing a business will come naturally, however there will be certain points in your business where you “hit the wall” and knowing some practical ways to get over the wall can be the difference between keeping your business healthy and letting it decline and become just another statistic.

Steps Not Leaps
Growth in a business doesn’t necessarily have to look like some of the biggest success stories out there for you to still be a success. While a success story like Google, Facebook or Microsoft may be the desire of most entrepreneurs, don’t let big aspirations rob you of the joy of small victories. For a small home business, a five or even two percent increase in profit year over year will keep your business healthy and continually push you one step closer to your ultimate goals.

Net Growth Is The Best Growth
Many small businesses can make the mistake early on of thinking that by bringing on more employees, this will exponentially increase the amount of revenues coming in and therefore increase profits. In actuality, for a lot of small businesses, having too many mouths to feed early on can be the death of the business. Whether your plan is to eventually exit the business through its sale or if you want to run it for the rest of your life, make sure that every hire you make is absolutely essential, because increasing revenue is pointless if your net profits stay the same; it just ads unnecessary complexity to the business.

Keep An Open Mind
Ultimately, the best and easiest way to continue to grow your business is to try new things and don’t be constrained by your preconceived notion of what your business should do. Many companies in the technology sector encourage their employees to spend 20% of their work week coming up with new ideas that have little or nothing to do with their day-to-day jobs, and this is where much of the innovation in the company comes from; so experiment with new products, marketing ideas or even a whole new business model, because growth doesn’t always have to be linear, or follow a pre-set path.
